i have a windows xp cd from my gateway with gateway written on it and stuff. (does that make it an oem or not?)

Yes, it makes it OEM. It also likely requires the CD to be in a Gateway that is the same model as your gateway.

If it does, it has all that gateway crap on it, you'll have all those gateway drivers installed, which can really mess up the install and give you a headache.
