Lock button stuck. Would apple give me a refurb?

My lock button is stuck. I've read that apple will give you a refurb, but the problem is I dropped it about 5 months before and the back screen is serevely cracked. Would apple still give me a refurb considering that the drop didn't cause this?
 
It depends on your genius. If your genius isn't nice, s/he may not replace under warranty due to the fall and make you pay the replacement fee.
