Let the games begin...
What is of interest to me is when/how the story was released.
Below is the order (as near as I can tell) of who released the story (as an aside, someone on another thread said I was wrong when I posted that the Tiger release would be news in the "Traditional" Media).
1) 02:41 PST Reuters News Service
2) 05:02 PST CNN
3) 05:18:PST Apple OS X Page
4) 05:20 PST Apple Home Page
5) 06:02 PST MacWorld
7) 0615: PST MacOSXRumors
8) 06:20 PST MacsimumNews
9) 06:40 PST MacRumors
As of 6:40 PST, no story on:
MacUser
ThinkSecret
slaskdot
AppleInsider
MacNewsBytes
So, the first 2 sources were "Traditional" Media... and they had the information at least an hour before any of the specialized rumor sites.

I wonder if the Mac mini will get a slight video upgrade then, since the Core Image compatable cards are listed as such.
Core Image-capable graphics cards include:
* ATI Mobility Radeon 9700
* ATI Radeon 9600 XT, 9800 XT, X800 XT
* nVidia GeForce FX Go 5200
* nVidia GeForce FX 5200 Ultra
* nVidia GeForce 6800 Ultra DDL, 6800 GT DDL
And I would hope that when Tiger is shipping on a brand new Mac, that brand new Mac would support the OS's technology. Even if not. Mac mini here I come, the ol G4 300 is lagging.

Steve jobs promised and delivered... The best engineers are at Apple, I don't doubt it one second!!! The most important thing for me is the 64 bits processing... I love the OS X, I love Apple machines but all the niceties in the applications are just OK for me...
I use a dualie 2.5 G5 + 4 Gb RAM + Ultra DDL... a pretty nice set but: what will 64 bits really bring to me? can someone be kind enough and explain what are the gains i am going to get.
I do a lot of Photoshop / FCP / DVD SP...
Thanks so much guys...

In my opinion it does indeed absolutely really means nothing else new for about 3 weeks.
Think about it. Would they put a "17 days until Tiger" counter on the front page, only to put it in a small box if something else came out? Would they put "PowerMac Quad G5" in a small box, also?
Apple seems to always only have one big announcement for their front page at a time. In my book this means nothing new for 3 weeks. Which also means that by then it should be the PowerMac Quad G5, which also means no iBook updates for at least 6 to 10 weeks.
Still hanging in there for an iBook mini, though. :D

I called the Apple store - I'm waiting on a Mac Mini order that I placed last week - to see if I was going to get Tiger (since I just bought and my order hasn't shipped.)
The girl on the phone told me that my Mini would probably not ship with Tiger, but that I will be able to purchase the "Mac OS X Tiger - up to date" program for $9.95.
I hope this is correct, since my order hasn't shipped. Though, if you listen to the phone message regarding such things, it says that those who purchase on or after April 12th are eligible for the discounted "up to date" program.
In the past, I believe they've extended this back 15 or 30 days if you bother them about it.

The most important thing for me is the 64 bits processing...
but: what will 64 bits really bring to me? ...
It's the most important thing for you, yet you don't know what it does?
First of all, the new 64-bit addressing won't help you since you only 4 GiB of RAM. The main thing that 64-bit addressing does is allow a *single* program to use more than 4 GiB.
Second, 10.4's 64-bit implementation is a partial implementation that is mainly available to command line terminal apps. No Cocoa/Carbon apps, no GUI apps.
For an applicaiton like Photoshop or video to use 64-bit addressing, it would have to be rewritten as a "client-server" app, with a 32-bit GUI talking to a separate 64-bit work piece. Ain't gonna happen, IMO.
The need for 64-bit on the desktop isn't that great, and the need for a lame terminal-only implementation is almost zero on the desktop.
The supercomputer clusters will like 10.4's 64-bit addressing, though....

Went to the Apple store site and found Tiger w/ EDU discount. I've got a G5 and an iBook (both running Panther) and will probably be getting a Mac Mini plus another iBook or another Mac Mini. Bottom line, I'll have 4 Macs pretty soon two of which might come with Tiger but two that don't. I want to upgrade and I guess the best way would be the Family pack with 5 licenses. Tiger requires a minimum of 256MB of memory and is designed to run on any Macintosh computer with a PowerPC G5, G4, or G3 processor and built-in FireWire.
The slot load iMac 350 G3 just had USB, but the PowerMac 350 G3 had firewire and was based on the same motherboard and had the same G3 chip.
Wonder if they will base the install on a ROM/ID check?

I hope to hell they extend it back a bit. I ordered a new mac mini in late March and was given an April 15th ship date, so I didn't figure I'd have any trouble qualifying. Well, it shipped YESTERDAY! I still don't have it of course, but I don't think it technically qualifies for the up-to-date program. We'll see what I can get them to do for me..
I'm in the same boat as you. I ordered a PB on Friday (8/4), it was supposed to ship today, but I just received an email saying that the shipping date has changed to 20/04  Does this mean I should expect to get Tiger?

It's good that 10.4 is finally announced. I had gotten a bit sick of drumming my fingers waiting for Apple to highlight something besides iPods.
But the announcement might not be able to overshadow the fact that Intel has begun shipping dual-core x86 processors (http://www.internetnews.com/ent-news/article.php/3496926). This leaves Apple with a shiny new 64-bit OS running on passé hardware -- unless, of course, they announce the dual-core Quad PowerMac G5 at NAB, which some posts earlier than mine say is unlikely due to the "three week rule" of Apple.com front page highlights, though ThinkSecret suggests otherwise (http://www.thinksecret.com/news/0504g5.html).

link to the Tiger up-to-date program for those who just bought a copy of Panther or a new computer:
http://www.apple.com/macosx/uptodate/
they claim its for if you buy/bought panther or a new computer on or after April 12th... Apple issued me a replacement laptop a little over 2 weeks ago, and i put in that info and the serial number with a sale date of April 12, and it approved me for the up-to-date program, with a media cost of $9.99 (did the same thing last year for panther, it's not the retail box, just comes in a padded manilla envelope with the media DVD).
i would say its worth it to try for anyone who has bought a computer/panther over the past month, it obviously wouldnt hurt to try.

Tiger preloaded would be likely.
It's the most important thing for you, yet you don't know what it does?
First of all, the new 64-bit addressing won't help you since you only have 4 GiB of RAM. The main thing that 64-bit addressing does is allow a *single* program to use more than 4 GiB.
Second, 10.4's 64-bit implementation is a partial implementation that is mainly available to command line terminal apps. No Cocoa/Carbon apps, no GUI apps.
For an application like Photoshop or video to use 64-bit addressing, it would have to be rewritten as a "client-server" app, with a 32-bit GUI talking to a separate 64-bit work piece. Ain't gonna happen, IMO.
The need for 64-bit on the desktop isn't that great, and the need for a lame terminal-only implementation is almost zero on the desktop.
The supercomputer clusters will like 10.4's 64-bit addressing, though....Ah. AidenShaw. You can always count on him when the 64bit myth must be debuked. I lik your avatar btw. Is it your cat?

Listed in included software is only iTunes, there is no other iLife applications listed.
Does that mean we have to buy iLife '05 seperately? Will we be able to install it from our original installations discs that came with our Macs? (I have the Rev D PowerBook and iLife '05 is on it's disc)

They have a media exchange program for $9.95. Download the

The best part of the media-exchange form is that "Apple recommends that you make a copy of the completed order form, install DVD, and proof-of-purchase for your records." Now, if we're exchanging a DVD for a CD because we have a CD drive, how are we going to copy a DVD? (yes, I know there are ways, but for the average user, this makes no sense).

Also, if you have a firewire cable lying around someplace, you can use Firewire Target Mode to install onto the iBook. Just put the iBook in FWTM, attach it to the mini, then boot up the mini with the install DVD. You'll be able to select the iBook drive as your install destination.

Quite right. Sun has a history of numbering Java versions in a strange way. Java 1.2 was called Java 2. Java 1.3 was Java 2 version 1.3. Java 1.4 was Java 2 version 1.4, or more specifically, J2SE 1.4, J2EE 1.4, J2ME 1.4 for Standard, Enterprise, Mobile Editions. Now Java 1.5 is being called Java 5 "Tiger" but also J2SE version 5.0, etc. Not to worry, Tiger will have Tiger.
Just a bit too late for me, though. I needed Java 5 (yes, we really needed Java 5 features) between January and April for a development project so I ended up running Eclipse over Remote Desktop to a Windows desktop. Sigh.

Well, to be exact, both iMovie and iPhoto were free applications when they were first introduced. iMove came out when OS 9 was still the main OS. It then moved on to becoming an OS X application. And it may have been "bundled" with one of the releases (maybe Jaguar).
iPhoto was never an OS 9 app. And it was also "free" at one time. But with the introduction of "iLife," the current versions became available ONLY in the box for $49. All of this was because of the introduction of iDVD, which could not be downloaded for free.

This is a cool feature that I have been using but haven't been able to talk about until now:
http://www.apple.com/macosx/newfeatures/newfeatures.html
Improved RAID
Use disk utility for software RAID, now including mirrored, striped, concatenated, auto mirror rebuild and block size settings.
Basically it lets you chain all the hard drives in your system together so they look like one big one. They don't have to be the same size, and it doesn't do striping or mirroring or anything, it just makes one big drive out of separate ones.

Yeah I noticed that all iLife applications except iTunes are missing from the list of 'included applications'
not that I am upset about that, I actually think that's a good thing. It comes free with new hardware but you buy it if you have older stuff. The price isn't that bad and I want them to make money off of it so they'll add even more home applications when the opportunity presents itself.
Still don't like the garageband name. Think it should have been something else but I'm not creative enough, it should have been iSomething.

Bottom line, I'll have 4 Macs pretty soon two of which might come with Tiger but two that don't. I want to upgrade and I guess the best way would be the Family pack with 5 licenses. Apple has the single user for $69 but couldn't find the Family pack with EDU discount. Anyone know if you can purchase the Family pack with EDU discount? Thanks
No Family Pack discounts at this time. I called and a very nice lady even went into their "hidden spots" looking for it. Since I have 5 Macs to update the $40 per Mac was a simple decision. If you can get 2 single copies for $69 each then that would be the cheapest route this time, then go with the family pack when OS X 10.5 comes out.

Improved Performance
Safari 2.0 on Tiger loads pages 1.8 times faster than Safari 1.2 on Panther.
Thank God!
And, appranently will be faster than Firefox in rendering pages...

Mmmmm....
I have the following external FW drivws
LaCie 160 (FW1)
LaCie 200 (FW1)
LaCie ITB (FW1/2)
I saw the RAID opitions in the DiskUtility but haven't used it
Some questions:
1) Does creating a RAID set destroy existing data on the member drives?
2) If not, how are the metadata/content stores maintaineed-- a single store or a store on every member drive?

It'll work, it's the same card.
Basically any "DX9 capable" card can do all the new stuff.

As has been reported, there is a list of cards that support Core Image listed at: http://www.apple.com/macosx/features/coreimage/ . I have been waiting to buy a my first mac, the mac mini until tiger was announced so that I could get the up-to-date program. I now see that the video card the mini ships with, the ATI Radeon 9200 is not listed as able to handle Core Image. Is this correct? I could be stupid, but is Apple marketing a new OS, part of which cant be handled by their new hot product? PLEASE HELP, I WANT TO ORDER MY MINI, but I want to make sure I should. I know there has been rumors of a mini upgrade, but nothing definite, so what should I do.

Should I upgrade to iLife’05 at the same time (£38) and what about iWork (£33), is it worth upgrading to replace MS Word (Office V.x)? I find Word so slow I’ve taken to using TextEdit and then using Word to format etc.

This is good news that we finally have the long awaited Tiger unleashed date, just 17 days to wait. Sadly Apple has not followed the trend with Mac OS X releases on the 24th. For some reason we are loosing protocol.
Sadly also the release date on the 29th is something that I had feared. I will be back on my diet research study, so won't be able to celebrate. My wife has to work that day. The 6pm timing for the party is earlier than the prior party times. Will need to be at the mall by around 4pm. Now to wonder if Steve will also have the 10% discount available.

Edit:
I'm not saying you didn't get screwed. I mean, your example is the definition of screwed, but... You could have easily kept yourself from being screwed. Going to the BBB, visiting MacRumors, you are obviously a smart or at least concerned shopper, but you are about as responsible for getting screwed as much as Apple is.
Now, if you had bought the computer without doing any prior research, then it'd be a different story, but you knew Tiger was on its way.
Besides, you don't expect Microsoft to give everyone who bought a computer 3 weeks before Longhorn came out to give them Longhorn for free, do you?

I feel like I've just been screwed with my pants on.First of all, whats the big deal? The computer was fine when you bought it, so why isn't it now? You didn't get screwed, you got exactly what you paid for, so quit acting like you didn't.
Second of all, there's some possiblity that if you complain enough, you can get tiger for free. You could also return the computer and buy a new one, only paying the restocking fee, which is probably ~$50. This fact could help you leverage them into giving you Tiger for the "up-to-date" price.
Thirdly, had you done a little research, you would have known the release was imminent, it was no secret, so why blame Apple?
Gosh, not to be rude or whatever, but you're sounding pretty darn immature.
P.S. There's a whole slashdot thread full of posts from people who faced the same situation as you, who, rather than cry about it, actually did something and ended up just fine. I understand that the mini is a budget computer, but you would still think apple wouldnt develop the mini and tiger during the same time period with the intent of not giving the mini the ability to fully take advantage of tiger. I guess my question for the technical folks out there is WHAT AM I MISSING GETTING A MINI IF IT DOESNT DO CORE IMAGE. I have heard that core image will provide the ripple effect when using dashboard. Now, obviously i'm not saying this makes or breaks anything, but I want my new first mac to be able to do all the cool things, that's one thing I love about macs. The more apporpriate question is could I have waited from Thurs to Tues... yes. And I would have if the worthless lumps at the Apple stores had been honest and forthcoming. Heck, I would have paid then and waited to take delivery. But no....
$129 may not be much to those of you with half a dozen computers and a couple iPods and software in abundance. It is to me and so I will not buy Tiger.

I AM WRITING THIS IN CAPS FOR A REASON. IF YOU JUST BOUGHT A MINI AND ARE WITHIN YOUR RETURN PERIOD, JUST GOTO THE STORE AND HAVE THEM RE-RING THE PURCGASE AT THE CUSTOMER SERVICE COUNTER. IF YOUR LEARY OF HAVING A MINI EXCHANGED FOR A MINI ON A RECEIPT THEN ASK THEM TO PUT THE REFUND ON A GIFT CARD AND RERING IT THERE. FYI- SOME RETAIL STORES REQUIRE TO INPUT THE SERIAL # SO MAKE SURE YOU WRITE THIS DOWN IF YOUR GOING IN WITHOUT YOUR MINI. HOPE THIS HELPS SOME OF YOU GET THE UPGRADE. Back to normal text now.

If the manager of the Apple Store will not honor the rep's statement then back up you data and tell them you are going to return the Mac and will then buy one that will have Tiger for free (actually about $19.95).
Also let the manager know about the BBB complaint and advise him you are forwarding a copy to Apple. Managers don't like problems and they certainly don't like the home office know they aren't taking care of an unhappy customer.
As for Apple's policy, they do have to have a cut off policy and they have set the date of the announcement as the cut off date. The validity of your argument is based on what an Apple rep told you and you have a right to assume good faith. In general, the policy is a reasonable one and a lot of potential buyers have been waiting for todays announcement before buying their Macs.

While they enjoy people who pay to upgrade to the latest OS, I don't think Apple is as concerned about OS piracy as they are about application piracy.
Every person who owns a Mac has paid for a copy of OS X at least once - when they purchased the Mac, which is different from the Windows world where someone can buy a system without an OS to avoid paying for it.
For Apple, the OS is strategic. Apple has to keep making OS upgrades or they'll be out-done by Windows or Linux and go out of business - regardless of whether existing customers are paying for upgrades. The truth is that Apple would rather have people buy new machines than upgrade to the latest OS - and Apple puts features in the OS release that takes advantage of new hardware to try to spur that along.
In comparison, iWork is more of a traditional software app. Not a lot of people are going to buy a Mac in order to use iWork. Instead, Apple has to make iWork attractive enough for Mac users to want to buy it separately. And, Apple has to make enough money on iWork sales alone to justify funding support and development.

The employees are under a NDA, a non disclosure agreement. Breaking it could mean being fired. There is also the possibility that they don't know anything more that any of us. That is the impression that I have. If they did, there are just not allowed to divulge.
Also on your receipt it should list a date by which you are allowed to return an item. At least mine always list a date for a no questions ask return. Never have had a problem.

Even senior Apple Sales reps have no idea what is coming down the pipe. I have a friend that works in Apple and there are times that I know things before he does. The people in the stores are going to be even worse than that.
This is no different than walking into Best Buy and knowing that the new "supergeewhizthing" is coming out in two days when the sales person has no real clue or care and until they do their regular meetings they don't (even then it's a stretch).

Second, who am I supposed to give more credence to: Apple reps in person at their store or some anonymous fan site? Hmmmmmmm.
Third, don't worry about the $129. Could I have gone three weeks? Well... my laptops battery died last Monday. Turns out that after 3 years of use it developed a short in the power circuitry and fried my battery. So... I could either pay $250 or so to have it repaired and the battery replaced or I could switch to a Mac. Figured it was a good time to switch.
Does that matter? Not to you or Apple apparently.
But it will carry some weight with the people I do business with when I inform them of my experience. I can guarantee they'll remember that if they consider switching.
Sadswitcher, I am sorry that your experience hasn't been as satisfactory as you'd like and I do hope that you are able to alleviate your concerns directly with Apple. Still, you claim to be doing business with other people, but it doesn't sound like you have a clue about the business world. You paid for a product and now you are upset that you are not getting a different product. Unless you have iron-clad proof of a deliberate misrepresentation by an Apple employee, you might as well shut your mouth. You can go ahead and misrepresent your own case to as many people as you like, but if your whining tendencies are any indication of your customer relations skills, I doubt you'll find them a very receptive audience. And what, exactly, will be the point of your complaints? That Apple sold you a product, after informing you that there was a new operating system on the horizon and that the release date was not yet well known? For a man with limited finances, a reevaluation of your fiscal irresponsibility might be in order. You obviously know how to use Google, you should have used it before plopping down an apparently back-breaking $400 - $500 dollars.

That said, you can:
1) Return to the Apple store and try to work out a reasonable compromise-- you will find that they are reasonable
2) Call Apple support & try the above.
3) Sell your mini to someone who doesn't need Tiger or will buy it for existing computers.

The Apple Store refused the return in person. I was told that if I was returning simply to get Tiger for free that they would not accept the return. Then I told them to keep Tiger and just give me my money back. They refused and told me to contact Apple directly if I had any more to say.
Told them I was going to the BBB. Left and contacted the BBB, complaining against the store and Apple.
ZildjianKX, I feel for you, that's an even worse story. That sounds like a CC charge reversal situation if you could swing it. I made the mistake of paying with a check which already cleared my bank (no stop payment possible).
I'm going to go have a smoke and calm down.
I can empathize, when your angry it clouds everything else. I'm not sure if I could have done it either, but would have not mentioned the real reason for the return. Especially not mention anything about Tiger.
The Mac mini is a good computer. A good place to start with using a Mac. The more important thing is that you begin to enjoy the use of your Mac mini. You are getting a lot of other free software like iLife and iWork, that most of us have had to pay. Hopefully later in the year you can afford to purchase Tiger.

That is the stupidest thing I have read.
Two: 6 freaking days after I buy something it's outdated. Thanks Apple, great way to encourage switchers.
erm, did your reseller tell you that Tiger would not be shipping? I'm not really the most up to date kinda mac user (still using my ancient 867 G4 powerbook and 10.2.8) but even I was able to check here and Apple's site to find out that a new OS was due. It is not Apple's responsability to hold you close to the breast.
BTW, my 2-year-old OS isn't 'out-of-date' as it still runs the software that I bought it to run, your's will too.

This is on the "Canadian" version of the Apple Store website. I'm trying to buy Tiger bundled with iLife and iWork (Discount)
www.apple.com/ca —> Store —> Mac OS X Tiger (top of page) —> Experience More & Save —> Mac OS X Tiger —> Experience More & Save...
It works on the US site.
Anybody can help me find a link out of this loop? Maybe I should simply order by phone.
Or maybe the rebate is automatically applied when you purchase all 3 products. :/
Note: The "Experience More & Save" picture on the canadian site displays the same price as the US store. Probably a mistake.

I have a hard time having any sympathy for anyone who complains that a vendor hasn't given them a "free upgrade" even if they purchased something 2-3 months BEFORE the upgrade was released (as I've seen posted here a couple of times).
Give me a break - the vendor (Apple/Microsoft/IBM etc) are in business to make money. They give reasonable rules for upgrades. They have the right to set the rules. Put yourself in their shoes... would YOU be giving away free hardware/software to someone who bought 2-3 months ago? (Again reference to those complaining about hardware upgrades - 2-3 months after they bought theirs!)
You go into ANY purchase knowing that something better may come out tomorrow (especially with computers and software!) - Ever buy something only to find out it goes on sale tomorrow? Happens all the time - that's life! The stores set up reasonable rules for getting that new price - but if you're outside the rules most likely your out of luck.
SadSwitcher: It is NOT Apple's fault you purchased before the date of the announcement - especially if you KNEW that Tiger was coming in the first 1/2 of the year (they told you that much). It isn't their responsibility to tell you when they are making announcements - just like stores don't tell you that the item you're buying today is going on sale tomorrow. I can tell you that Apple employees are not told in advance of any announcements so it isn't a lie when they give you their opinion.
Take responsibility for your actions and you'll feel better about your life.
That's my opinion and I'm sticking to it :)

I read your responses after I posted the suggestion.
If you feel you have a legitimate complaint, try the following, without getting loud, angry or using threats.
1) Return to the store and tell the store manager that: this is your first experience with Apple; that you think that you have not been treated fairly. Give the reasons why, and ask him to work with you to arrive at a solution that is acceptable to both parties. (be prepared to give some ground).
2) If he refuses, tell him that you still are not satisfied and that you want to escalate the matter to his superior (District Manager, I think). Ask him to make the call with you.
3) Take notes at each step
You can use this approach with the store, Apple Support, and Apple Customer Relations department (call Apple headquarters).
You should be able to escalate this all the way up to Steve Jobs, if you think it is warranted.
I have used this approach with several companies and the issue was always resolved to my satisfaction.

The only difference between you and me is I didn't believe my Apple Store sales rep. I was in there two weeks ago and almost made the purchase. He said, "sure we'll upgrade you to Tiger as long as it comes in before July". Didn't sound plausible. Another thing he said is you can return any Apple product within 14 days no questions asked as long as you haven't opened the software discs.
I understand your frusteration, it sucks - but take a deep breath and enjoy life. :)
Apple rep tells me a story.... I buy based on that story.... who's fault is it?

purchased something 2-3 months BEFORE the upgrade was released
Sadswitcher said he made his Mini purchase 6 days ago or something, theres a big difference between 6 days and 2-3 months.
I purchased my Mini at the end of March and I knew Tiger was coming soon. I decided to go buy it cause I couldn't wait :) I'm still going to give Apple a call to see if I can get an upgrade, but I won't cross my fingers. Panther is 10x better than Windows 2000 which I was coming from. If I don't get an upgrade then I'll use my EDU discount this summer to pick Tiger up.
Sadswitcher, it stinks that right after you purchase your Mini Apple announces Tiger. Call up Apple and explain the situation. If you don't get the upgrade is it that bad? Tiger could be buggy and you might just be better off waiting until you can purchase it and its matured.

I've been lied to before by sales reps. they say stuff to sell stuff, regardless of the truth. I'm really suprised that people are calling this guy a troll. Fan boys I guess take any criticism of Apple a little too personally.
I would talk to a manager, and explain that you want to return the computer. Inform him/her of any applicable state laws. iff that doesn't work, call your state's attorney general.
I can't believe that other members expect you to take the word of a bunch of nerds of various websites OVER that of a representative of the company.
Sales Reps should know better, but they don't....they want to sell computers, and may stretch the truth.
again, you should be able to return the computer and should pursue any action against Apple to get satisfaction.
Apple isn't perfect. it isn't infallible. They just make sweet computers/software/etc.

Also no G-5 Powerbooks in 2005.
So no "New G-5 Powerbooks next Tuesday" posts until next year.
that's as exciting and relieving to me as tiger being announced.

One: Apple rep said "if Tiger is released in two weeks" it's free. Guess he was playing word games. He should have said shipped in two weeks. He also told me it wasn't out and that he didn't think it would be out for some time. Dangerously close to a lie there.
If he indeed said "I don't THINK it will be out for some time" then it is obviously his opinion and therefore isn't a lie. IF he had said "we've been told it won't be out for some time" then maybe you have a case.
I agree that the rep's wording was bad on the "released" phrase. You can work with the manager on that one.
Again, I think like the others have said, if you talk to the manager reasonably and make logical points, you may still get the upgrade. But Apple has every right to set up a policy for upgrades and you're outside of it so unfortunately, you may be out of luck.
I also agree with everyone else that you've indeed got a better computer and better OS than you had. So enjoy it and upgrade when you can find the money.
Good luck!

Since you use your mouth hole for spewing a bunch of *****, it does not surprise me that you are able to be screwed with your pants on.
Pay for the software you want, otherwise you have no right to bitch about it. I ordered the family pack to pay my just dues, even though you have been able in the past to install OS X on multiple computers.
Seriously, don't you think you're being kind of a jerk? it's not like this guy was using any sort of derogative language. Why bring it down to this level?

RETURN & REFUND POLICY
If you are not satisfied with your Apple purchase of a pre-built product, please call 1-800-676-2775 for a Return Material Authorization (RMA) request within 14 calendar days of the receipt of the product. If the item is returned unopened in the original box, we will exchange it or offer you a refund based on your original method of payment. The product must be returned to the Apple warehouse within14 calendar days of the issuance of the RMA. All products must be packed in the original, unmarked packaging including any accessories, manuals, documentation and registration that shipped with the product. A 10% open box fee will be assessed on any opened hardware or accessory. If you purchased your order using an Apple Business Lease, you may be asked to provide a major credit card (Visa, MasterCard, American Express, or Discover) for Apple to assess the 10% open box restocking fee.
Please note that Apple does not permit the return of or offer refunds for the following products:
Product that is custom configured to your specifications
Personalized iPods
Opened memory
Opened software*
Electronic software downloads
Software Up to Date Program Products (SW upgrades)
*You may return software after rejecting the licensing terms, provided the software is not installed on a computer. However, software that contains a printed software license may not be returned if the seal or sticker on the software media packaging is broken.
NOTE: Apple recommends that you (1) use a carrier that offers shipment tracking for all returns and (2) either insure your package for safe return to Apple or declare the full value of the shipment so that you are completely protected if the shipment is lost or damaged in transit. If you choose not to (1) use a carrier that offers tracking and (2) insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping. Please not that the United States Postal Service (USPS) offers limited tracking capabilities and that there is a 30-calendar -day waiting period before the USPS will initiate a trace.

And what thread are you reading? Nowhere do I read that any member suggests that anyone should "..take the word of a bunch of nerds of various websites OVER that of a representative of the company." Now if I remember correctly, Steve Jobs is a representative of the company. He posted a Keynote on Apple's website regarding the release of Tiger first half of 2005, right? Hmmmmmm, a rep on a various website. Go figure.

First, Sadswitcher, it's not Apple's fault. The deal at the time you purchased was Mac Mini with Panther. You knew Tiger was around the corner. What do you expect of Apple? The rep to tell you "PSST Don't buy Tiger is due to be announced on the 12th!" Do you expect them to say "Oh, well even though this product wasn't announced offically when you bought your computer, you'll get it for free anyway."
Think about this logically. Bottom line is you purchased something before a free upgrade was announced. Your timing was off.
Second, I was in a similar situation with my 12" Powerbook when Panther came out
Go to http://store.apple.com/1-800-MY-APPLE/WebObjects/AppleStore?partNumber=M9643Z/A
and put in your information. My Powerbook qualified at the time even though it was bought before the cut off.

Question from UK perspective -
Student price brings it down to £58 - according to Apple person on phone who took 5 minutes to find out so probs unreliable
Second, can I get the student discount price at an apple store? i.e. hopefuly the Birmingham store will be open by 29th, so can I get it there for student price?
Just pre-ordered mine from the apple store at £58.75. Don't think Apple stores in the US honour SD so maybe not, maybe call Apple Store in London and ask them?
Panther finally arrived about 2 weeks late last time, so be prepared to wait if you order on line.
