Updating ip4 to ios5 w/phone not actiavted

had a 4. got a 4s. got 4s activated and working. not impressed.

old phone still has old sim card in it etc just not activated.

can i do the upgrade to ios5?

also att said if i can swap sim cards from 4 to 4s (so 4s card in 4) the old one will work.
