How is Polaroid getting away with this look alike nano?

Wow i was browsing on ebay deals of the day and notice this polaroid mp3 player that looks just like the ipod nano! Hwo come apple is not suing them for the design and such?

I was going to say they perhaps don't want to kick them while they're down but Apple went after Kodak recently so I suppose that reason doesn't really work.

Wow, if that is what Polaroid resorted to, how the mighty have fallen.

It's probably not even polaroid, maybe a chinese knockoff.
You know, like the other TEN MILLION.

The cost would outweigh the benefit, as the iPod Nano isn't a very profitable sector for Apple.
