your choices are to wait, fight the machine and argue with the mfrs after you bought or fix it for about 5 bucks...I would try this:
get a few of these:

embed or super glue this to the spot on your case cover that will trigger the ipad function, apply a mini piece of black elec tape to the mag surface, so it does not scratch the pad...
done...
