iPod iPod nano bad refurbished with dead pixel on first day!

So I just got my latest iPod nano from the first gen battery replacement, and it already has a dead pixel!

This is my first time ever to have an Apple touch screen product that has dead pixel on a first day of use. :eek:

My question is do I have 3 months of warranty can I still get it replace under warranty?

PS: I'm here in asia for work so I got it replace at an authorize premium reseller.
