With a website with navigation along the top, and some text and images beneath it on top of some subtle textured background:

1. is the navigation, text and images considered the positive space?

2. Even though the background is subtle, can someone say that they see the background textured image as the positive space and be correct from a graphic design perspective?

1. Yes.

2. Not really as the negative space is the area where there's no content, unless they were really being a jerk about it and then I'd tell them I just really don't care. There's no practical application to that answer.
