Problems with ipod backlight

The backlight on my ipod doesnt seem to switch off, i just have it a couple of weeks and only charged it a couple of times, I've tried going into settings and turning it off and it just flickers back on again, iam afraid cause if i leave it on all the time it might waste the battery quicker.

You can try formatting the iPod with the iPod software restore, if it's a software problem it should fix it (you'll have to download your music to it again after)... if that doesn't solve it, send it to Apple, it's probably a firmware or hardware issue...
