Apparently if you are 5 foot 1 inch and a bit, you get a get out of jail free card for sexual assault of a minor. I wonder where the cut off point is. 5'2" 5'3"?. Just think if is were the 70's and this guy had a teased hairdo he'd be looking at 10 years.

Well, he is going to be watched closely for the next couple of decades. And he probably would have gotten messed up pretty bad in prison. But I can't say I'd be upset if what he did to kid(s) was done to him. Only worse.

I have a feeling he'll be caught doing something that'll send him straight to jail next time anyway.

Probably true. The said thing, though, is that will be one child whose life wouldn't have been messed up had he been sent to jail this time around.

Agreed.

And I know this may sound stupid, but here it is ---- maybe instead of letting this guy go rather than putting him in jail, I think he should be put in jail, and the guards at the jail should to their job instead of letting this sort of thing go on. Yeah, there's a chance he'll be someone's bitch in prison, but if guards offered this guy, and any of the prisoners, any sort of protection from this sort of thing, then people like the judge wouldn't be so concerned over such things.

I am quite certian he will be caught too ... after he does something. Who knows how much damage he will do between now and then !
I think our judical system would be improved if we concentrated more on what we did in all branches than what someone is doing on MySpace that has yet to commit a crime. ( my 2 cent )

Personally I think the guy should rot, but it seems like our current justice system can't pick a winner in a one horse race.

I'm only 4'11"... is that too short for prison? Or is it different for girls? Considering my height (or lack thereof) and overall tinyness, I'd probably just get killed in prison, no matter what.

He'd be killed/beaten/become a bitch in prison because he molested a 12 year old not because hes short! And he deserves it. Hell, they should make prison abuse mandatory for rapists and child molestors.

as luck would have it, they sort of do. Snitches, rapists and anyone who abuses children usually have it fairly rough in prison. (from what I hear anyway)

The sad part is how few of these cases get convictions or are ever reported.

Not that I think about these things, but i wouldn't be surprised if this guy is short in other areas as well, thus his need to resort to sexual violence against innocent children. A real man would not destroy an innocent child's life.

I hope to god he doesn't become a repeat offender. It is bad enough those out there we cannot catch or don't know about than letting another one loose.

No punishment is too harsh for what he did - even chemical (or physical) castration to reduce his disie to attach innocent children.

He should be put in prison. I don't think wishes for more sexual violence by other prisoners is going to make anything better, though.

If a judge knew that the guy would be very likely to face abuse (e.g. rape) in prison, and sent him there anyway, any chance that that would be a violation of the criminal's 8th amendment rights (cruel/unusual punishment)? Just throwing that out there.

How could a judge "know" this? A judge surely would expect that prison services fulfill their duty of care. Similarly a commanding general would not "know" that soldiers under his command would deliberately slaughter (http://www.timesonline.co.uk/article/0,,2089-2200170,00.html) innocent women and children in Iraq, even though the possibility would always exist.

I don't think there's much you can do to treat child molestors, short of chemically castrating them.

Everyone is concerned with the rights of the criminal, but never the rights of the victim.

Everyone runs the risk of getting beat up in jail. It's not supposed to be a fun place.

What they could do is break both his legs stretch him out a bit and reset the bones. Then they could jail him with a clear conscience.

There was a young girl in the UK a few years ago who had this operation under the NHS as she was too short to be an airline hostess. But she had continual problems thereafter.
