iPod 5G+ ipods and smart playlists

I have a smart playlist I use for unplayed podcasts on my iPod Photo, and one thing that bugs the crap out of me is that once I listen to a podcast, it will remain in the playlist until I sync with iTunes. So are the newer gen iPods any better at managing this or do they require a sync too?

I'm not looking to manage one, I am wondering why it won't update itself based on the criteria I set. I've read that this was an issue in the past, but shouldn't be an issue anymore. Maybe I will just reset it.
