Because you're not supposed to have it as a regular user. Everyone that has a legit copy is under NDA.

Hmmm... I see.
well....if it makes ya feel better, I'm not in the states, so DMCA doesn't apply to me....I haven't broken any laws obtaining a copy.
But yeah....I'm buying it when it's available...and I wouldn't recommend using the beta unless you're extremely curious.
I was just pointing out that I think this is going to be a killer release...even though there seems to be a lot of people dumping on it...before they even try it.
So yeah...don't download it for everyday use....and don't break any copyright laws were you live.

You broke a law by downloading software that isn't yours and you dont have a right to have.
the DMCA doesnt matter..

Nonsense...for example, when I went to Vanuatu the summer before last (without the copyright protection we have) I could legally buy home ripped/burned DVDs, games etc.

well.....I got it, that's all that matters.
As soon as I start distributing it...then that's against the law.....or if I sold a copy...then that's against the law....getting a copy is not against the law.
But I'm not giving this to anyone.

But someone must have given it to you, and that person must have broke the law. You then took it and used it knowing full well that it was made available to you illegally. I don't think knowingly being in possession of stolen goods is legal.

hmm....nobody stole anything....and I don't have any stolen goods here.
And I have no idea of the legality of what someone else does.....if I got this copy while on vacation in tuvalu or timbuktu....then who ever gave it to me didn't break any laws....if I got it in the states, then I probably violated copywrite laws....which is quite a bit different than stealing....but I didn't obtain it in the USA.
so....

Any developer with a copy of Leopard is under an NDA with Apple making it illegal for them to release any information on the OS or copy it an give it away. These are the terms of the NDA and have nothing to do with DCMA. It is illegal to distribute via the terms of the NDA which should be a valid contract globally so where you obtained it is irrelevant.
