What's the given Apple waranty with the iPod Touch? It seems like a few people are already having issues with it and contemplating exchanging it. Does Apple charge a restocking fee in that scenario? Also if I've bought mine through Amazon, does the same Apple warranty still apply? Thanks

ive heard that it was a year but i have had no concrete proof

Yes, it is a full year, and anytime in that year you can get the AppleCare protection plan.
