Photoshop CS3 oddity

Hi all. When using the screen option to have the background black in PS CS3, I have noticed a couple of times that the tool pallate behaves in a very odd way. Basically, when clicking on to a tool, it is the tool below it that is activated. This only seems to happen when the black background is chosen. Does anyone else have this problem?
