What firmware ships with the Apple TV 40GB?

I received mine 2 weeks ago with 1.1 and has been working mint ever since

Weird thing with mine is I bought a refurb through Apple and received a brand new one hmmmmmmm I'm not complaining

Bought a 40 from best buy a few days ago and it came with 1.0

I imagine if you want the old firmware most stores will have stock old enough to still have 1.0.

Why the 40GB?
The price difference isn't all that much between that and the 160GB, is it?

You gotta get an OS.dmg from a 1.0 restore. Good luck with that.
