can you restore it from itunes? alternatively, can you contact the seller for the password?

Well, that's not to restore, that is to put it in recovery mode, but you could try it.

not sure. but can you not just press the restore button in itunes?

Edit: actually, never mind. if that phone isn't synced with your computer, i don't think you'll see the screen i attached. sorry.

Sounds fishy to me for some reason. Call apple, they should be able to help you or take it in to an apple store. I'd leave negative feedback if I were you, if that's where you got it...

if you are going to leave neg feed back on ebay wait until the last day to leave it and close to the last hour because of retaliation.

If need be, couldn't you file a PayPal dispute or charge it back with your credit card company (if you paid with a credit card)?

i suppose (it's such a hassle) but is there anyway to erase the existing number on the phone and reactivate the phone

The number should be tied to the sim.

Are you sure the phone isn't stolen? I would check with AT&T and have them look into the imei number.

I dont think AT&T keeps stolen IMEI in a database.
Anyway I would suggest removing the SIM thats in there.
Get an Unactivated SIM put it in the phone.
iPhone will then display a message different SIM or something to that affect. You can then plug into iTunes and begin the activation with you number.
Your current SIM if you already have AT&T will become deactivated and the SIM in the iPhone will be you new one.

The whole thing just screams of a stolen phone to me.. Did it come with a box, leads and manuals?

Have you got a link to the eBay auction so we can check out the guy you got it from?

I dont think AT&T keeps stolen IMEI in a database.

If you report a phone as stolen they can flag the IMEI. They won't go out of their way to track it down, but if you buy the phone and bring them a number they can check to see if it's legit.
