iPod ipod nano 3gen battery indicator problem

hello all,
my ipod just started doing this. the battery indicator does not change, it always shows a full battery. however, when the main screen times out and goes dark the battery indicator on "this page" shows correctly. should i return it?

Just us iTunes to restore it, should fix the software glitch.
