It's always crashing like every other songs. Sometimes it lags, sometimes the song skips, sometimes the screen is slow at response. It's been like this since 1.1.2.

iPod touch was introduced on September 5, 2007, so it's still under 1 year warranty.

Why do you think it's out of warranty? Only reason it'll be out of warranty at this time is user damage.
