is this normal for a brand new MBP with 3 loadcycles?

Yah its normal. my mac wont charge unless its below 95% charged, I have 9 cycles on battery and had the mbp when the the day the penryn's mbp's launched

It depends - do you mean you are charging it and it reaches 97% and then stops? Then your battery needs to be calibrated.
If you mean you have noticed it on 97% and it not charging - Mac Books don't charge the battery until it drops to around 95% to prevent excessive charge discharge cycles while it is plugged in.

Well it is a desktop replacement, so it makes sense to see MBPs with that kind of cycles in that length of time.

drain it past 95%, then charge it and keep eyeing it occasionally until it actually stops.
once it reaches 100 percent it begins to trickle charge. During this time your battery will slowly decrease in % until it hits 95 and charges again.
