Will the Apple store replace my iPhone 3g?

I have two issues so far:

- slight light leak on the left side of the phone, and
- there is a piece of dust under the glass that protects the camera lens

Thing is, I got my iPhone from an AT&T retailer. Will Apple replace my iphone, and will I get a brand new one, or a refurbished one due to the fact that I got mine from ATT?
