A US judge has thrown out a case against God, ruling that because the defendant has no address, legal papers cannot be served.

The suit was launched by Nebraska state senator Ernie Chambers, who said he might appeal against the ruling.

He sought a permanent injunction to prevent the "death, destruction and terrorisation" caused by God.

Judge Marlon Polk said in his ruling that a plaintiff must have access to the defendant for a case to proceed.

"Given that this court finds that there can never be service effectuated on the named defendant this action will be dismissed with prejudice," Judge Polk wrote in his ruling.
Mr Chambers cannot refile the suit but may appeal.

'God knows everything'

Mr Chambers sued God last year. He said God had threatened him and the people of Nebraska and had inflicted "widespread death, destruction and terrorisation of millions upon millions of the Earth's inhabitants".

He said he would carefully consider Judge Polk's ruling before deciding whether to appeal.
The court, Mr Chambers said, had acknowledged the existence of God and "a consequence of that acknowledgement is a recognition of God's omniscience".

"Since God knows everything," he reasoned, "God has notice of this lawsuit."
Mr Chambers, a state senator for 38 years, said he filed the suit to make the point that "anyone can sue anyone else, even God".

Brillaint story, although I am confused by this sentace:

I bet this is not an isolated case either. Just happened to get carried in the press.

Note, I am not bashing Democrats with my comments. I am sure that this is merely an example of a typical bipartisan stunt.

There's nothing quite like a little righteous indignation to start your day.

It's an amusing stunt, but I don't understand the point the man was trying to make. Was it political or existential?

Heh..

I know this guy, personally. State Sen. Ernie Chambers, from Omaha. He's been in office since before I was born. He's actually represented North Omaha for YEARS. Went to the church my mother goes to. He was a nice guy, but I don't know where the hell he got this one from!

I read about this yesterday in Omaha's newspaper before accidentally spitting out my tea all over the paper! Good 'ol Ernie is getting a bit senile, I guess, because he is planning to appeal.

Anyone ever notice that the guy looks like a darker, grey-haired version of the caveman from the GEICO commercials? :D

At least in Seattle, homeless people are allowed to use a street corner as their residence to vote.

Well, John Doe never votes. Jane Doe can't be found. Jose, Jesus, and Julio are afraid of being arrested for outstanding warrants or unpaid bills because of an "official letter."

Very few of these suits go to trial. God might be willing to settle out of court.

I think this will be put down as an intentional tort and make it into the tort casebook. While he's at it, he should also sue God for negligence.

As for criminal law, that's tougher since any crime God pulls off has to be proved beyond a reasonable doubt, and that fact that many doubt God's existence, this case may not get off the ground. :)

It would be called "an act of God," which is normally exempt from liability.

State Sen. Ernie Chambers is suing God. He said on Monday that it is to prove a point about frivolous lawsuits.

Chambers said senators periodically have offered bills prohibiting the filing of certain types of suits. He said his main objection is that the constitution requires that the doors to the courthouse be open to all.

"Thus anybody can file a lawsuit against anybody -- even God," Chambers said.

Chambers said he decided to file the lawsuit after a suit was filed in early September in federal court against Lancaster County Judge Jeffre Cheuvront. He's the judge who was hearing a sexual assault case in which the plaintiff wants to use the words rape and victim during her testimony.

Jurisdiction question... you apply the minimum contacts test as provided in International Shoe... if there is enough contact between God and NB, then god can be sued in NB...

Although I think you can only sue human beings and God isn't human, so it might not work... but you could argue that Jesus is human.....
