For monetary reasons I had to get rid of the iPhone service and am now using a Razr (ugh). I have a 1st gen iPhone so I am still using it as a iPod touch, but my question is if I unlock it, can I use it with the SIM card from the razr and just not use the data?

Yeah. When you unlock, you can use non-iPhone AT&T plans. Just call them up and tell them to forcibly block data from your SIM. They have to do it, and that way you won't incur those dollar-to-the-megabyte charges.

This works, but you will not have visual voicemail.

Aside from not having a continuous network connection, I believe that is the only side effect.

How would I check my voicemail otherwise?

You get a Red Dot as the Voicemail Indicator - press the Voicemail button and it calls the Voicemail system. That's the way it works for an unlocked phone on T-Mobile.
