Touch charges for a second then doesnt charge

My 1G iPod Touch has been acting very weird over the past couple days, it will do the following

Charge, then say its not charging.
Go to sleep, then 1 second later say its charging, then not charging when nothing is connected to it.
Not charge at all.

It is not charging with my iMac at all, i have tried 3 different cables to no avail, so that means it wont be able to do a restore. and i can not turn the device on, or i get the Red battery, stating it needs charging before it can be turned on.

I bought the device when i got my iMac this summer, should i be able to get a new one?

Just tried it with my Dell desktop, nothing.
