First off, I am on AT&T using a 2G iPhone that was given to me that I jailbroke and unlocked, so I am not paying for the data plan. I am using a sim card that is about 5 years old and not a 3G sim card.

My questions are:
1. If my friend sells/gives me his phone if a new one comes out in the summer, can I use my old sim card in the 3G phone? I do not receive 3G in my area, so I wouldn't be missing out on any speed by not having a 3G card.
2. He has updated the latest software to 2.2.1 so it is not currently unlockable, just jailbreakable (he doesn't jailbreak his phones). If I jailbreak it, can I activate it without going through iTunes or AT&T so I don't have to sign up for the data plan, or can you only do that if it is unlocked?

Anybody with an answer???

Please read the rules and don't bump threads.

1. Yes.
2. If it isn't unlocked, you can't get service outside of AT&T at all.
