I've got a brand new iPod photo 20GB, I bought it a while ago but the clickwheel started to have issues so they replaced it with a new one, its still sealed in the "Do not steal music" plastic wrap that all the new ones come in. I called apple while they were out if it was going to be a new or refurb and the guy said that it was new because they were trying to get rid of their over stock of the photos.
I'm going to include all the stuff that came with it originally (including the box) and it is still eligible for apple care for another 6 months.
