So my iphone got stolen and I just figured I'd have to wait for the new one so I could get the subsidized price, but now it seems like that's not possible? I don't want to pay 399 after getting nothing for my old one. The thing to find out eligibility on apple's website isn't working for me.

if you have a family texting plan take it off your plan for 30 seconds hit next then put it back on your plan. Now you can continue through apples store page.

As sucky as it is, AT&T could care less that it was stolen. All they know is that they picked up a good portion of your 3G price and you then owe them a certain amount of time before you are eligible again. Upgrade policy is applied just like normal.

Sorry that it was stolen, and I hate to say it, but I think you are out of luck concerning at&t. If I was in your position, I would wait until you are eligible for the upgrade pricing. Apple's website just worked for me.

OP, just buy the new one and have data removed. This way you will save $30 a month on your bill.

The iPhone is worth $700. Smartphones, without a plan, are hella expensive.

And just because you lost your phone, as sucky as that is, does not mean you are entitled to a new one. If someone stole my laptop, I wouldn't expect a new or discounted one from Apple. It was my fault, not theirs.

Aren't you in a contract with AT&T still? You must be otherwise you could get the new iPhone for $200.

Hopefully nobody steals your Pre because Sprint handles subsidies the exact same way that AT&T does. (And the full price of the Pre is $549)
