Besides the ethical aspect, is it possible to upgrade Office 2004 from a copy of the previous version (i.e. using the UPGRADE version) or is it necessary to uninstall the old version, purchase the STANDARD version and then install it?

If you have a previous version of Office on your system, then the Office 2004 Upgrade will work. Is that what you're asking?
Ethics aside, you could purchase the Student/Teacher version of Office 2004 and it'll be a full install. The only downside is if you needed Virtual PC.

I'd be pretty surprised if this thread didn't get wastelanded.
What you're asking about is illegal, whether you agree with Microsoft's business practices or not..
