I was going to get DS a new nano (his other one was stolen) but see there are some refurb'd ipod touches on apple's site. Any reason NOT to get a refurb?

Not unless you really want the fancy box.

Occasionally, there will be some visible wear and slight damage; but it's unlikely. Refrubs are usually like-new items that have been professionally cleaned and repaired, with the same warranty as new items, so it's definitely the best choice IMO. :)

Now he can decide if he wants the nano ($99) and another gift, or the touch ($179)

My thoughts exactly. Refurbs are a great buy; they come with all of Apple's warranties, are usually as new, and have been individually tested and tried. Okay, you won't get the fancy packaging, but to my mind, that's a small price to buy for an excellent deal.
Cheers and good luck
