Here's my story: I leave the country... tomorrow. And want to use an iPhone in a new country. So, I jailbreak and unlock mine. I don't use any other apps, don't do anything different than my normal routine, just a new carrier for the year.

I come back to America in 1 year, and I buy the new iPhone, whatever model it is. I back up my jailbroken one, sync that backup to my new iPhone, and I have all my texts, call logs, pictures, everything easily sync'd onto my new phone.

Question: Do I also have the jailbreak files on my new phone? I don't want those - I don't want Apple to think I voided my phone warranty, when I didn't (well, I did for my iPhone 3G, but that's two years old by now...), and I never plan on using a jailbroken iPhone again.

The files will still be there because you backed up a jailbroken iphone. just restore as new phone. and apple cant find out that you jailbroke it as long as you do a full restore. am i correct?

Ya, you are correct. I would suggest using something like address book to get your contacts from your phone and use iphoto to get your pictures then when you buy the new phone "create as new phone" and sync everything over.

Well, what I really care about are my texts: I havent deleted any since I go the phone, and want them with me on my new one... would a resrore as new phone copy my texts as well?

If you restore as new, you will lose all your texts.

restoring as new will delete everything, I think if you restore the new one to the jaibroken backup, you won't need to jailbreak and music texts everything will be sent across

Does that mean the jailbreak will still be applied, or it will be a new phone without the jailbreak?

As far as I'm aware, the backup function ONLY backs up settings, messages, photos, voicemails, etc. It doesn't back up ALL the files and entire file structure of the iPhone.

I don't think that anybody would be able to tell that you had jailbroken your previous iPhone, especially if all you're installing is ultrasn0w to get the unlock. I secondly don't think that anybody at apple would ever even bother looking at the file structure of your particular iPhone in the case of a warranty claim.

I'd hazard a guess that detailed checks of why an iPhone failed would only be carried out by Apple in the case of a very unusual warranty issue such as the "exploding iPhone" that came out of France the other day.

So my advice would be to jailbreak, install ultrasn0w, and forget that you even jailbroke it until you get back to the states and restore it...

If you are on a mac then use Syphone (free) to save your texts.
