Out of box 3GS with 3.1?

I am planning on buying a new 3GS for use in Costa Rica (thus needing to be unlocked) however I am aware that if the phone is in 3.1 then there is no way to unlock it (for now). Does anybody know if the iPhone 3GS's currently sold at stores come loaded with 3.0 (thus unlockable) or 3.1? Alternatively, is there any way to know from the serial number?

Got one on Friday with old firmware. They told me to upgrade using itunes :p

Not to mention that he cannot unlock even then because the baseband would be upgraded.

my buddy picked one up at a apple store last week and it had 3.01 on it but they upgraded it to 3.1 before he left the store... He tried to not let them but they basicly said they had too before it left the store..
