My MMS refuses to work with wifi on

So i have 3.01 running on my iPhone 3G and i'm using the 5.1 carrier file but i cant send texts with wifi on. Is there any way i can achieve this by changing some sort of setting? Or do i have to get 5.5?

I have tethering option available with 5.1 and i'm afraid if i upgrade to 5.5 i will lose that. Any suggestions?

upgrade to 6.0 ipcc just google "at&t 6.0 ipcc" the exact file name your looking for is ATT_US_STEALTH.ipcc
