O2 also has the sticky problem about hardware locked handsets. Should the PAYG phones be unlocked? SHould those handsets out of contract be able to be unlocked? It's technically doable, shown by other markets.
Might help bring tethering prices down too.

By whom? I think he's kind of missing the bit where the majority of phones are sold at launch and shortly after.

I don't think so. Some will, but most people probably won't even look at the mobile phone market until their contracts are nearly up.
