Hope you have good lawyers. I can't imagine this is legal.

Addendum: Behold:

http://rogueamoeba.com/support/knowledgebase/?showArticle=NicecastLegal

Nicecast can be used to create a stream of your own music (to which you own the copyright), of other copyright-free music, of your own talk or call-in show, as a baby monitor, and many other ways. All of these are perfectly legal and have no fees associated with them. However, streaming of copyrighted audio may have regulations and minor fees associated with it. Please see this link for more details on US webcasting laws.

Laws in your other countries may vary, so be sure to consult a lawyer if you're planning a commercial station.

Hi there and thanks for your reply,

I have acquired all of my music via legal means, (and I mean in the thousands). I understand that if I get more than 10 listeners at any given time I simply won't continue to broadcast. I am literally testing the water, however I appreciate your concern.

I will bear this in mind. Thanks again :)

Glad you're paying attention to this.

All you need is one listener who fingers you to the RIAA or other authority. Or one music-industry toady trolling this message board and looking to make an example of someone. It's good that your 20k+ songs were legally-procured, but you don't own their copyright (unless they're your own performances, in which case you've been a busy boy!). Broadcasting stuff whose copyright you don't own or haven't licensed over the Internet (or over a conventional radio station) raises licensing and royalty questions that you'd be wise to investigate before putting anything out there. Much depends on where you're located, but other issues such as your ISP's terms-and-conditions need to be considered too.

Just, be careful. That Nicecast stuff is way cool, and it sounds like tons of fun, but they put that legal commentary up for a reason. You may be exposing yourself and your family to some rather dire legal harm.

Thanks for your second reply. I have closed down the software now and will be heading to bed as it is 4am over here.

I think maybe I'll rule out this little project after all, or look at getting some kind of licence to do said activity.

Thanks for the heads up. :o
