I have recently replaced my 3G and upgraded to an IP4. For some reason the old 3G still shows in find my iPhone along with the new iPhone 4. Is there a way to remove it from the list of phones?

Yes. Select the 3G phone and on the map overlay for that phone there is a little button at the top right (I think it was red). Click that button and a pop up offer options including removing that phone.
