can at&t track an iphone that was stolen during delivery could that person still use that phone?

Are you saying that your 4S was stolen during delivery? Unless you know the imei number of the device you can't really do much.

dont know the imei is ther anyway to find it out?

So you bought a stolen iphone 4s? If the EMI number has been reported stolen it might not get activated. Were you able to activate the phone?

i never recieved the phone was wondering if that person would still be able to use it?

At the iPhone hacks section.
Not like it would do you any good but it can be blacklisted by AT&T.
But the thief can still sell it as is, make up an excuse and get it replaced by apple with a clean white listed device etc....

It will be unlocked and sold overseas. You will never see it again and it will be used by someone else.
