I bought a used 3GS recently on Craigslist, and the phone works fine, but has some cosmetic damage on the back of the phone.

The phone is still under the original warranty.

I have a few questions:

1. As a used phone buyer, am I still covered under the original warranty? Will the warranty cover the cosmetic damage?

2. Can I extend the Apple Care 2 extra years, even though I am not the original buyer and don't have proof of purchase from a retailer?

Yes, you are still covered under the warranty since it is the phone that is covered and not affected by who owns it. You can still get Apple Care for it.

You don't need a receipt to get Apple Care, just buy it and activate it on the website. Apple Care will only extend the warranty for an additional year after the original one year warranty expires.

Warranty will not cover cosmetic damage.
 
if you're a good BSer, you can get yourself a replacement. i do it ALL the time when i have cosmetic damage on my iphones.
