is it possible that itunes locked my iphone?

somehow i got a passcode on my phone after buying it off someone on ebay. it was fine for 1 day, then i put it to charge on my computer before i went to sleep and in the morning when i tried to use it, it had a passcode on it. i dont want to restore it on itunes because ill lose my unlock if i do that, i tried the passcode too many times and now it says "iphone is disabled connect to itunes" is there any way i can get rid of the passcode? please help me.

any help would be very appriciated. comment please.

Edit: it's a 3gs on firmware 4.0.1 and baseband 5.13.04
