I used my sister's upgrade so my data plan remained unchanged. Do I need to go by AT&T and get them to change my data plan to iPhone 4s to see faster hspa+ speeds or is having the newer hardware enough?

Nothing needs to be done. The baseband will auto-negotiate the higher speed if available in your area.

Weird....I had to call AT&T.
They are going to tell you to call. That's not the same as being required to. The system will eventually swap it over to the 4S data plan. I am not even sure why a different data plan for the 4S exists.
