I used my sister's upgrade so my data plan remained unchanged. Do I need to go by AT&T and get them to change my data plan to iPhone 4s to see faster hspa+ speeds or is having the newer hardware enough?

You will have to call them and provide your new IMEI number.

Nothing needs to be done. The baseband will auto-negotiate the higher speed if available in your area.

nothing needs to be done. i've actually asked attFail for new sim card after doing the same & the speeds were the same (4-6mb) vs 2mb on 4, same sim
 
I bought the 4S outright (no contract) and I had to get a whole new sim card. Not sure why... but they also changed my plan while they were there.
