I know its bad to torrent copyrights, but is windows 98 a copyrighted on torrent websites?

Yes, Windows 98 is still subject to 'copyright'.

So technically, isn't everything on torrent websites copyrighted?

No, not necessarily. There are certain torrents which are legal, and can be legally downloaded using torrents websites. For example Linux distros. These are open source and available for anyone one to download.
