flickering Brightness on the "new" ipad HELP!

i just got a new ipad a week ago ... ive been noticing that when i play a video but only while playing video the brightness on my ipad flickers.. it dims down and up as charters move or move their hand in front of the screen... now i noticed theres a post here :https://discussions.apple.com/thread/3822777?start=0&tstart=0 with the same problem and everyone saying that they have this problem.. so.. do you guys notice this? does it happen on your ipad? should i return it ? also if i end up returning it since it hasnt been two weeks is it posible to get it replace for a bran new one not a refurb.. i had bad experiences with refurb iphones before so i prefer not to have a refurb ipad.
