Old iphone 3gs and new iphone 5 keep auto syncing over wifi. need help

Whenever im on wifi or i turn the old 3gs on, the apps and notes all sync automatically. I was planning on unlocking and giving the old 3gs to my mom and so i deleted all my notes on it. Then i found out all those notes were deleted on my iphone 5. I have no idea how this happening, can anyone help me?
 
Your using the same icloud account on both. Switch it off on the 3gs and create a new account for icloud for it.

Note you can still share an account for purchases if you want, you just don't want to share a account for icloud.
