If it was a trademarked name they could do it, but as it is a surname they probably wouldn't be able to fo it. ICANN will usually be strict in these cases which would benefit your case. Remember to turn on registrar lock if you haven't already done do.

A friend and biz partner of mine and I have both had firstnamelastname.com domains for over 15 years, and never had a hint of an issue. While my name is a little less common, it's not way off-the-rails, and his is very common.

Way back in the very late 90s, very early 2000s we started using me@<your_name>.com which I always thought was fun for personal correspondence.

As long as it isn't someone else's trade mark (as MacSociology said), you have as much right to register and use it as anyone else.
