They already have done that because of stock issues. And I hope most people understand that they don't deserve an iPad 4, as they bought a 3rd gen.

No way they did that. They're not allowed to do that as they have to *exchange* your product for the same one (hence why they ask for your serial number).
I don't think brown box replacements are always refurbs. They could be new, but most are probably refurbs.
Actually, it does happen from time to time, that they are short of certain models. There have been numerous times this has happened in the past:
- When short of iPad 2 64GB, they upgraded to iPad 2 64GB 3G
- When short of white 16GB iPad 3, they upgraded to iPad 4
- iPhone 3G is upgraded to 3GS most of the time due to low stock
- For a while, iPhone 4 32GB White was swapped for 4S 32GB White
Their policy is to upgrade if a part is constrained. Same goes for laptop hard drives, iPod, etc etc etc.

What's wrong with some of you people? The OP isn't looking for a handout, but a replacement. And it might cost Apple either the same amount to produce the ipad 3 versus the ipad 4, or it might cost more to produce the ipad 3, since it'll be a lower volume. And guess what? They are no longer producing the ipad 3. There is no option to buy it anymore. So it makes perfect sense to replace the ipad 3 with the pad 4. And it makes perfect sense to ask if Apple will be doing that.
The difference is that Apple still sells the iPad 2 and has been for nearly two years, whereas the 3rd generation iPad was sold for about 6-8 months.
thats wrong, apple often replaces items with the newer version at their retail stores. If someone comes in with an iPhone 4 16GB, and they have no replacements to give them, they will give them a 32GB, if that isn't in stock they will give them a 4S 16GB.

So you know, for a fact, that all Apple stores are unconstrained on all 12 models of iPad 3?

if you don't believe me, go smash your iPad 3 on the pavement (presuming you have AppleCare+) and take it to your local Apple Store for replacement. if they don't have your model, i'll refund you the $49 deductible. how's that for a bet?
