I can't help but think that one day, all the money companies get from lawsuits will outweigh revenue from their products.

They already do in some cases. They are called Patent Trolls, example: Lodsys LLC. Their revenue from lawsuits is so good they've never had to make an actual product. They don't even have to invent anything either as they can just buy patents from actual inventors.

Apple's worst mistake was assembling a product in a country that is so corrupt that even its own patent office could be bought out from! They should just close up shop there and bring the company home and that they learn from there lessons.

Yep, that's the ticket. Close a factory in a poor area where thousands of jobs will be lost, just so they can move to another area where the manufacturing costs are massively higher, the people are lesser skilled and that will drive the price of the products up.

This new suit won't net Apple anywhere near $1 billion, assuming they win.

This isn't a new lawsuit. Apple has already been awarded $600 million which the Judge agreed with. This is to recalculate the damages on the additional $400 million or so that the Judge in the case felt the previous Jury miscalculated.

Judge Lucy Koh had no choice but to issue a new trial for the damages. The jury worked on bad instructions in the original case and came up with an improper verdict. If she had let the last trial verdict stand, it would have been easily thrown out in Appeals Court and they would have admonished Judge Lucy Koh. She knew that very well and hence, here we are.

The trial will be held in mid Nov. 2013 and a verdict will come after Thanksgiving. With final judgement most likely in Jan. 2014. By that time we'll have the iPhone 5s, iPad5 and iPad Mini 2 well in the public with iOS7. Samsung will have the GS4, Note3, and a few flagship tablets available with Key Lime Pie (Android 5.0). Samsung will immediately appeal and seek relief by asking for the penalty to not be rewarded to Apple and remain in escrow. The Appeals Court will significantly reduce judgement or throw the entire case out. By this time we'll be in 2015 and there will be clear winners in the mobile computing market. Those winners will be Apple and Samsung. Sony, RIM, LG and HTC will have exited the market. Motorola and Nokia will be niche players and serve development devices only for Microsoft and Google.

Not this crap again. Seriously Apple and Samsung both need to focus on keeping up their quality smartphones and stop all this bickering. my 2nd grade students don't fight this much.

There should be a new trial in another state to make it a fair trial. But wait for the patent office to review the patents in question to insure they are legit or deemed worthless.

Well, they're not, and Judge Koh has already decided that the $1 billion was excessive.
Judge Koh has never claimed the amount was "excessive". She said there were problems with how it was calculated by the jury so they will have a new trial for a jury to re-calculate the damages regarding some of the devices. Koh also put back $40 million into the original judgment that was supposed to be part of this new trial.

Samsung is risking another billion. Good. Love them to get what the copycat deserves.

It would be amusing to see them award more the second time around.

----------

Is this why there are no new inventive products coming out ? The big boys are too busy suing each other ????

Get over it kids and get back tor releasing cool stuff already

Clearly a lot of people don't understand. No matter what happens at this AWARDS trial Samsung owes apple 600 million. The only amount in question is the 450 million.

So Samsung will have to pay 600 million to 1 billion plus. No matter what happens Apple has already been awarded 600 million dollars.

Given this second awards trial I would say the odds of an appeals court overturning or reducing the award is very small.

Apple products are not assembled/made in Korea genius.

The second trial has nothing to do with appeal odds

Judge Lucy Koh had no choice but to issue a new trial for the damages. The jury worked on bad instructions in the original case and came up with an improper verdict.

Instructions were detailed and clear, the problem was the jury screwing big time the damages calculation

The trial was fair, why do you say it was not fair?

What patent office has been bought?

This judge Koh needs to go. This is at most beyond any reasonable statute of limitations and at worst double-jeopardy. The ruling on the field is final. Leave Samsung to appeal it if they want.

Furthermore, if you're going to strike $450m, just do it but don't have another trial to redetermine how much of that shouldn't have been struck down in the first place. I mean wtf?

This has to be the most wishy-washy court dealing with patent lawsuits.
