My take on the temperature situation is, well, it's technically in-spec, and Apple likely has all sorts of access to Intel data when making these decisions. Running at these temps violates 'best practices' in the DIY/overclocking community, but it's probably not quite as crazy as it seems. One does not, after all, seem to hear about an alarmingly high rate of CPU failures in Macs.
