*Yawn* - yet more disputes - when is it going to end?

Not content with being one of the finest tech companies ever, bolstered by more cash reserves than quite possibly any other company on the planet, Apples insatiable need to prove their superiority spurs them on. Out to impress the world with their bad ass legal team, they're on a roll.

Funny how quickly people forget the past. Had Xerox gone after Apple for all they stole, copied, and pilfered, Apple would not exist today.

Even Steve Jobs himself came out with public statements boasting about how much they copied. Yet when the shoe is on the other foot he railed with his now famous "go thermonuclear" quote.

Apple is nothing if not a group of ego centric hypocrites...

An American company goes to an American court to sue a non-American company. We all know how this court will rule. No bias here.

There isn't much Samsung can do despite all the lawyers they have. It's an unfair fight.

As an Apple zealot, I am glad that Judge Koh is on our side and doesn't even pretend to be objective or impartial.

Can't tell if sarcastic or just trying to fortify the Apple fanboy stereotype... :confused:

Samsung has no own ideas like 3G and 5G technology? Apple is using 2 essential patents from Samsung for data transmissions and an American court will of course not rule in favour for a non-American company. Without Samsung's inventions, there would be no iPhone because it would not work.

Inventions such as pinch to zoom are no "inventions" from Apple since other manufactures have "invented" it a long time before the iPhone. And Apple is build on stealing others work such as Xerox.

Its trials like this that just show how broken the patent system is.

How can anyone approve a patent for things like auto-correct and slide-to-unlock?

Apple didn't steal anything from Xerox, which is why Xerox never sued. There's nobody at Xerox who think Apple did anything wrong, if anyone is to "blame" for that whole thing it's Xerox's management itself for selling Apple their technology. The key part in the story here is that Apple paid Xerox.

If Samsung wants to copy Apple, they'd better pay, just like Apple paid Xerox. Since Samsung didn't pay, now they're getting sued so they have to pay.

No, Samsung to date has not paid Apple any legal fees or any settlements.
(As far as I have read…)

Yes, Xerox sued Apple. Go read some history. You can start with this NY Times article from 1989:

"Xerox's suit, which was filed in Federal District Court, charges Apple with copyright misrepresentation and seeks more than $150 million in royalties and damages.

"Xerox contends that the Lisa and Macintosh software stems from work originally done by Xerox scientists and that it was used by Apple without permission."

There were plenty of people at Xerox who thought that.

In fact, the person whom Jobs asked to give the demonstration, Adele Goldberg, famously warned Xerox that Apple was going to steal their work. Her boss, Robert Taylor, was out of town at the time, but later said he would've told Jobs to "get out".

Xerox did not sell anything to Apple. Nor did Apple pay Xerox anything.

Xerox did license Smalltalk 80 to Apple, but that was TWO years AFTER Apple's famous visit... and that's ALL they said they licensed.

Apple legal team should bring the Blackberry duo to the stand, to recall how they too were taken by surprise when Steve showed off iPhone for the first time. Well, we did get these guys out of business but still! For old times sake, perhaps, a scotch on the rocks in one hand, a pipe on the other, they might sit us by their side and recount the legend of iPhone.

It's just Apple's design that stands out that makes it seem like there are a disproportionate amount of Apple products in this video. What about the Dell computer in the BG of the courtroom? What about the countless other (ugly and fat) laptops and computers seen throughout this video? We don't even know what brands they are, but we know what Apple's ones look like.

Doesn't change the fact that Apple products will be in a video shown to the jury of an Apple lawsuit. The other brands are irrelevant because they are not part of the trial.

I loved the British judge who put Apple in their place and told them to run adverts on their website saying that Samsung didn't copy them.

I think that it's a pretty disgusting practice to show so many Apple branded
products in a "Pre-Trial" instructional video on Patent law !!

That should have never been allowed, no matter which opinion you have.

Where is the "Justice" or "fairness" in that ??

Judge Koh should be ashamed.

Apple paid Xerox in the form of Apple stock. In exchange, they got a 1-day tour of PARC with the explicit goal of learning about how Xerox were implementing a GUI and so that Apple could do the same.

Saying that Apple copied Xerox is an overly simplified way to convey the bigger story, so people mention it a lot that way. Unfortunately other people interpret that incorrectly as an admission of guilt for a design theft that never happened.

Here is the story straight from the horse's mouth, Bruce Horn, who personally worked on the GUI at Apple, and the GUI at Xerox PARC, which pretty much makes him the authority on the topic:

Yeah now that I think about it, you're right. At the very least the video shown shouldn't have contained either companies products.

Yeah, that's pretty egregious. There's another example at 5:20 where the "inventor", using a sleek Apple laptop, is speaking with a patent attorney who appears to have big old clunky PC laptop.

I can see why Samsung would be a bit upset. It probably could have been worse: the video could have shown Samsung devices as examples of patents being rejected.

Most of the computers shown are non-Apple. Sure, they are clunky, because that was the state of the world at the time the video was shot-- anything sleek and commonly available for a video shoot was Apple. So outside of the sequence at 4:10, there is no legitimate cause for complaint.

I hope Samsung gets sued for $40 billion. Their profits on smartphones are complete and total theft.
