Data retrieval

Back ground
My brand new seagate hard drive just developed a hardware fault (tested with apple hardware testing software), unfortunately at the same time I have discovered that my new time capsule did not actually produce a valid back up file from time machine - despite me setting it up to do so. My old back up device has gone!

Problem
Hard drive error on mac partition, windows partition still works
File vault encrypted data needs to be retrieved

A new hard drive is arriving and I will fresh install SL but was wondering if anyone knew of any possible solutions to salvage the data on my dying hard drive? I can boot into windows but not mac. From windows I can access the mac file structure, but with file vault it reports my user folder as being empy.

Are there any pieces of software that may help me retrieve my data?
Any companies who do this?
