Photoshop Help

My brother-in-law wants to frame this picture of him, his dad and his son (my nephew), but would like to get rid of the background people. It will be a Christmas present for his Dad. I tried, but failed miserably. Also, this photo was taken with an iPhone so it's not excellent, but it would be great if the dimensions and quality are kept so it can be printed at 8x10. Cropping the picture so that more of them are in frame would be preferable as well. Thanks.

That's awesome! Thanks, I knew that guy in the background couldn't be completely erased, which is completely fine. But, again this is great. Thanks again!!
