if it's an AT&T 3gs it is not factory unlocked.

check and see if it's unlocked on this site with the IMEI number:
http://dev.mk/iphone-simlock-status-imei-checker/

What is the BB of the phone?

Did he buy this phone on the resale market ?
Sounds like he got scammed.

in the website you have provided, there is a link which charges for a permanent unlock from at&t... wanna know if it is reliable???

no he did not buy it from the resale market... it was bought from an apple store..
it does seem like the poor fellow was scammed...

Apple doesn't scam people, your friend just didn't understand what he bought.
The good news he can IMEI unlock it for about $5 since it is an AT&T model.

Many threads here about IMEI unlocks.

dnt remember the baseband, but the phone has been updated to the latest ios 6...

I have factory unlocked iPhone from 3G to 5 and I don't remember seeing the box saying unlocked iPhone.
