How to find a genuine iphone 5 battery off ebay?

If phone is less than a year, Apple will replace it. There's normally a charge after a year but you might be able to get the charge waived (particularly if the battery has really failed).
 
as far as I know there are no seller outside apple and their reseller to sell authentic apple battery, most of them is "oem" or build to specification which the seller would argue it is the same thing as original.

Exactly.
You wont find Genuine Apple internals on ebay or on the net. They are all build to spec similar to factory apple replacements but they are not the same exact parts used by Apple and manufacturers that do produce them for apple are not allowed to sell them to the public. But they do make similar replacement parts just as good quality as OEM.
